Draft design for our approach to regulating Network Rail in CP6
This document sets out our approach to regulating Network Rail in control period 6 (CP6, which will run from 1 April 2019 to 31 March 2024, as we have consulted on it in the draft determination. Its purpose is a tool to express our proposed framework for regulating Network Rail in a succinct way.

In March 2018 we published our working paper which sets out our proposed approach to balance the benefits of Network Rail being able to respond flexibly to changing circumstances against the benefits of our PR18 settlements for Network Rail's routes and the system operator.

Conclusions on the overall framework for regulating Network Rail
Following careful review of the consultation responses and the valuable engagement we had with stakeholders, in January 2018 we published our conclusions on the Overall Framework consultation.
Along with a letter setting out our conclusions, we also published an updated version of the design framework and a further supporting document summarising stakeholder responses and setting out our comments on these.

In July 2017, we published our consultation on the 2018 periodic review (PR18) Overall Framework for regulating Network Rail in CP6. The consultation sought views on:
- putting an increasing focus on regulating each of Network Rail's route businesses;
- encouraging closer working between Network Rail and operators;
- making greater use of comparison between routes to incentivise delivery; and
- strengthening our regulation of Network Rail's System Operator function.
This approach should facilitate Network Rail to become more efficient and responsive to the needs of its customers, strengthen its accountability, and contribute to better outcomes for passengers, freight customers and taxpayers.
The consultation comprised three documents:
- a main document consulting on the overall framework for regulating Network Rail; and
Two subsidiary documents on:
- route requirements and scorecards; and
- possible measures of the System Operator's performance
Consultation on the overall framework for regulating Network Rail
This consultation set out how we will regulate Network Rail in CP6. Topics covered by the consultation included the role of scorecards; the role of customers and ORR in holding Network Rail to account; and how ORR and Network Rail will manage change in CP6. The design framework summarised the policy positions outlined in the main consultation document.
We received a total of 37 responses to the consultation on the overall framework for regulating Network Rail which are available. We would like to thank everyone who responded.
Consultation on route requirements and scorecards
This document focused on the requirements we expect to make in relation to Network Rail's geographic routes, and the freight and national passenger operator route. In particular, it looked in more detail at what measures and targets we may wish to include on the scorecards for these routes for CP6. The annex to this document comprised draft impact assessments covering areas where our policy represents a material change to PR13.
We received a total of 14 responses to the consultation on route requirements and scorecards which are available. We would like to thank everyone who responded.
Consultation on possible measures of the System Operator's performance
This document set out a range of measures that could be used to assess the performance of the System Operator and hold it to account against. This consultation was intended to support stakeholders in their ongoing engagement with the System Operator on the contents of its scorecard. In addition to the main consultation document, there was also an annex containing the full list of measures in a spreadsheet format.
We received a total of 22 responses to the consultation on possible measures of the System Operator's performance which are available. We would like to thank everyone who responded.
