Description: 

The notice was served following a recent incident whereby an unbraked carriage ran away and collided with a train and requires the duty-holder to ensure reasonably practicable measures are taken to ensure unbraked vehicles are suitably secure. They have not ensured, so far as is reasonably practicable, that persons not employed by the organisation are not exposed to risks to their safety, as they have not taken sufficient precautions to ensure unbraked railway vehicles are suitably secured when not in use and are therefore unable to runaway resulting in the risk of a collision.

They have failed to provide adequate welfare facilities and arrangements for Driver’s and Conductor’s operating Class 313 trains, between Brighton Station and West Worthing Station. This includes toilets and the adequate time to access them. Therefore, as an employer they have failed to ensure so far as is reasonably practicable, the welfare of their employees whilst they are at work.
