Summary:
A member of Clarke Chapman Facilities Maintenance staff working at Beeston Modular S&C Depot contracted Pontiac Fever. ORR’s investigation found that there was no responsible person or deputy nominated to manage legionella risk, no written scheme of control, no up to date schematic, inadequate record keeping and remedial measures were not carried out promptly following legionella being detected in the system. These requirements are laid out in HSE’s Legionnaire’s disease ACoP and guidance (L8).

Summary:
ORR received concern in relation to potentially unsafe construction of a footbridge on the Helston Railway, a wholly volunteer run heritage railway in Cornwall.
Site visit undertaken on 8 July 2025 identified that construction of a footbridge, known as the ‘Black Bridge’ near Trevarno Station was being undertaken by the dutyholder after the original contractor had stepped away from the project.
Dutyholder had taken on responsibilities of Principal Contractor. No Construction Phase Plan detailing the health and safety arrangements for the safe construction of the bridge had been produced by the dutyholder and the construction methods being used differed from the previous construction plan produced by the original contractor.

London Underground have failed to conduct their undertaking in such a way as to ensure, so far is as reasonably practicable, that persons not in their employment such as members of public are not exposed to risks to their health and safety as a result of failure to implement effective measures to deter and prevent unauthorised access to railway infrastructure beyond the platform end barriers, namely to operational railway tracks and exposed high voltage electrical conductors

Summary:
The ongoing investigation into the circumstances of the freight train derailment at Audenshaw on 6 September 2024 shows that Network Rail are not conducting their undertaking in such a way as to ensure so far as is reasonably practicable, that train passengers and other persons not in their employment who may be affected thereby are not exposed to risks to their health or safety as they do not have appropriate arrangements in place to ensure that track maintenance activities which are needed to manage train derailment risks are effectively planned, organised, monitored and reviewed.
