Description

Its purpose is to ensure effective coordination and cooperation between these organisations in relation to the regulation of health and safety, including policy matters and the enforcement of health and safety law, on all Britain’s railways, tramways and other guided transport systems.

The Health and Safety (Enforcing Authority for Railways and Other Guided Transport Systems) Regulations 2006 (as amended) allocates enforcement functions to ORR and clarifies whether ORR or HSE is the enforcing authority for particular activities. Separately to the MoU, ORR and HSE have created a guide setting out our shared interpretation for how this will work in practice in different situations.
