In this consultation, part of ORR’s periodic review 2023 (2023), we present initial proposals for reform of Network Rail’s possessions regime.

We sought views on our proposed revision of ORR guidance on application of the Railway Safety Regulations 1999 (RSR 99) to Mark 1 type and hinged door rolling stock when operated on railway infrastructure where line speed exceeds 40kph.

We sought views on a new draft guidance publication 'Principles for managing level crossing safety'.

The proposed risk management maturity model (RM3) for the rail Heritage Sector.

For holders of EU passenger licences we updated their GB Statement of National Regulatory Provisions (SNRP) as well as their station licences on 3 December 2019. On 24 June 2020 we also updated those operators who just hold station licences too. For operators who provide traction only services, we have now modified their SNRPs.

Consultation to revise the Accessible Travel Policy (ATP) Guidance. This aims to improve the availability of accessible vehicles for use by disabled passengers during rail disruption, and to ensure passengers know where accessible buses and coaches will be operated.

Two rail companies have applied to ORR for exemption from the law which requires the provision of automatic train protection (ATP). The application relates to specific Chiltern Railways trains operating on Chiltern routes, south of Aynho Junction.

Following this consultation we have published our policy statement relating to a progressive approach to infrastructure authorisation.

We are making changes to the model track access contract to reflect new arrangements concerning access arrangements for the Core Valleys Lines (CVL). These are particularly relevant for those who wish to operate freight trains between the CVL and Network Rail Infrastructure Ltd’s (Network Rail’s) network.

A summary of our draft conclusions on the final Five Year Asset Management Statement (5YAMS) that was submitted to us on 31 May 2019. It is the culmination of the first phase of our examination and draws from detailed analysis that is explained in a number of supplementary documents published alongside it. Together these form the draft determination.

Consultation outcome In January 2020 we published a consultation on an updated monitoring framework and enforcement policy for Highways England, titled Holding Highways England to account. This new policy replaces our existing monitoring framework and enforcement policy for Highways England and comes into effect for the start of road period 2, from 1 April 2020. We received 17 responses to the

updated guidance, reflecting the European Commission’s Implementing Regulation (EU) 2017/2177 of 22 November 2017 on access to service facilities and rail-related services (stations, light maintenance depots, freight terminals and other sites and associated services).

Following our consultation in March, we are now updating our regulatory arrangements 2013 for the way we deal with Network Rail's land disposals.

We have published the results of research which reviews complaints handling in regulated sectors which have an ombudsman.

Alongside the Accessible Travel Policy Guidance and the responses themselves, we have published a summary of the responses, and set out the steps we will take to ensure train and station operators, including Network Rail, deliver these improvements.

Following our further consultation, Eurostar's request and subsequent alternative proposal were considered by the ORR board at its meeting on 18 April 2019. This letter to Eurostar sets out the board's decision and the reasons for that decision.

In November 2018, we published a consultation on a new regulatory policy for holding Network Rail to account for delivery of the commitments in our determination, and the obligations in its network licence. This new policy replaces the existing economic enforcement policy for Network Rail and comes into effect for the start of Control Period 6.
